3. Our Services

All services are subject to a site survey and written agreement before work commences. We reserve the right to decline any project at our discretion.

3.1 Free Consultation

We offer a free on-site consultation to all prospective clients. The consultation is without obligation and does not constitute a contract. No charges apply if you decide not to proceed after a consultation.

3.2 Subcontractors

We may engage trusted, vetted subcontractors to assist with or carry out certain elements of your project. We remain responsible for the quality of all work carried out on your project.

4. Quotes & Estimates

4.1 Written Quotes

All quotes are provided in writing and include an itemised breakdown of materials and labour. A written quote is valid for 30 days from the date of issue, unless otherwise stated. After this period, material costs may have changed and the quote will need to be reissued.

4.2 Variations

If, during the course of a project, unforeseen circumstances require additional work or materials (for example, discovering unsuitable ground conditions or drainage issues), we will notify you immediately and provide a written variation quote before proceeding. No additional charges will be applied without your written approval.

5. Payment Terms

5.1 Deposit

A deposit is required to secure your project start date and to cover the cost of materials ordered on your behalf. The deposit amount will be stated in your written quote. The deposit is non-refundable if you cancel less than 14 days before the agreed start date, except where we are at fault or the project is cancelled by us (see Section 6).

5.2 Stage Payments

For larger projects, stage payments may be agreed in writing prior to commencement. All stage payment milestones will be clearly defined in the project agreement.

5.3 Final Payment

The outstanding balance is due upon completion of the project, following the final walkthrough. Payment is due within 7 days of completion unless otherwise agreed in writing.

5.4 Accepted Payment Methods

We accept bank transfer (BACS), cash, and any other payment methods stated on your invoice. We reserve the right to charge interest on overdue payments at the rate set out in the Late Payment of Commercial Debts (Interest) Act 1998 (8% above the Bank of England base rate) for any invoices unpaid beyond the due date.

5.5 Disputes

If you dispute any element of an invoice, please raise it with us in writing within 7 days of receipt. Undisputed portions of the invoice remain payable on the original due date.

6. Cancellation & Rescheduling

6.1 Your Right to Cancel

If you are a consumer (individual, not acting in a business capacity), you have a statutory right to cancel a service contract within 14 days of entering into it under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

To exercise this right, contact us in writing (email is acceptable) within 14 days. If work has already commenced at your request within the cancellation period, you may be charged for the proportion of services completed.

6.2 Cancellation After 14 Days

If you cancel a confirmed booking more than 14 days after contract formation but less than 14 days before the start date, we reserve the right to retain the deposit to cover costs already incurred (materials ordered, time allocated, etc.).

6.3 Rescheduling

We will make reasonable efforts to accommodate rescheduling requests. Please give us as much notice as possible. Rescheduling with less than 7 days' notice may result in a rescheduling fee to cover labour allocation costs.

6.4 Cancellation by Us

In the rare event that we need to cancel or significantly reschedule a project, we will give you as much notice as possible and offer either a full refund of any deposit paid or an alternative start date at your choice.

6.5 Weather & Force Majeure

Landscaping work is subject to weather conditions. If severe weather makes it unsafe or impractical to continue work, we will reschedule at no additional charge. We are not liable for delays caused by events beyond our reasonable control (force majeure), including extreme weather, material shortages, or utility strikes.

7. Liability

7.1 Our Liability to You

We carry appropriate public liability insurance. In the event that we cause damage to your property through negligence, we will work with you and our insurer to resolve the matter promptly.

7.2 Limitations

Subject to Clause 7.3, our total liability to you arising from or in connection with any project shall not exceed the total value of the contract for that project.

Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any liability that cannot be excluded or limited under English law; or your statutory consumer rights.

10. Complaints

We take great pride in our work and aim for 100% customer satisfaction. If you are unhappy with any aspect of our service, we encourage you to:

  1. Contact us directly — raise your concern with Billy or a member of our team. We will aim to respond within 3 working days and resolve the issue within 14 working days
  2. Put it in writing — if the matter is not resolved to your satisfaction, send a formal written complaint to our email address
  3. Alternative Dispute Resolution (ADR) — if we are unable to resolve your complaint, you may wish to use an ADR scheme. We will provide details of an appropriate scheme upon request

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to your rights as a consumer to bring proceedings in the courts of your country of residence if different.
